Terms of sales
These “General Terms of Sale” apply to legal operations affecting Products marketed to its customers by Red Luxury SAS within its virtual store.
The words or phrases below shall have the following meanings:
- Internet shop: means the website of Red Luxury SAS on which the Products are presented and sold to customers.
- Order: shall designate the sales contract concluded between Red Luxury SAS and the customer of the Red Luxury SAS Internet shop.
- Product card: means information pertaining to a Product provided by Red Luxury SAS at the time of the Product sale on the internet shop.
- Products: means all goods and services sold by Red Luxury SAS on its internet shop.
- Service: designates the selling of Products by Red Luxury SAS to the customers of its internet shop.
- Transaction: refers to all operations, secure processing, authorizations and agreements inherent to payment of the price of the Products Ordered by credit card.
Article 1: Object
1.1 – The present General Terms of Sale aim at defining the terms and conditions under which Red Luxury SAS offers and sells Products to its clients. These General Conditions of Sale shall prevail over all other conditions contained in any other document, except in case of prior, express and written derogation.
Article 2 – Acceptance of Terms
2.1 – The customer acknowledges having read, at the time of placing the Order, these General Terms of Sale and expressly states to accept them unreservedly.
2.2 – The present general conditions of sale govern the contractual relationship between Red Luxury SAS and its customer, both parties accepting them without reservation.
Article 3 – Products
3.1 – The majority of Products offered by Red Luxury SAS customers is immediately available. However, all Products marketed by Red Luxury SAS may or may not necessarily be sold online.
Article 4 – Order
4.1 – The automatic registration systems are considered as proof of the nature, content and date of the Order.
4.2 – Red Luxury SAS will confirm to the customer the acceptance of its Order by sending a confirmation message to the email address that the latter has communicated. The sale will not be concluded until the sending of the Order confirmation.
4.3 – Red Luxury SAS reserves the right to refuse or cancel any Order from a customer in particular in case of insolvency of that customer or in the event of a payment default of the relevant Order or earlier delivery or a dispute relating to the payment of a previous Order.
4.4 – Information specified by the customer when entering information inherent to his Order commit him. Red Luxury SAS cannot be held responsible for mistakes made by the customer in the wording of the Order coordinates (in particular delivery address, billing address) and delays in delivery or failure to deliver the Products Ordered that these errors could cause.
Article 5 – Delivery
5.1 – After the Order confirmation and subject to full price payment of the Ordered Products, Red Luxury SAS is committed to deliver to its customers the Products Ordered at the delivery address within 6 days.
5.2 – All Products stipulated in the Orders placed with Red Luxury SAS are intended for the personal use of the customers or recipients whose name is mentioned at the delivery address.
5.3 – When appropriate, the customer agrees to pay upon receipt, all taxes, duties, levies and other charges present and future due for delivery of the said Products themselves; joint liability of Red Luxury SAS cannot at any time be engaged in this respect.
5.4 – Customers or recipients of Products are not allowed to resell Products in whole or in part.
5.5 – Our shipping rates are partly included in the price of each watch.
5.6 – In case of late delivery exceeding seven (7) days, Customer may, if they wish, except in cases of force majeure, denounce the registered sales contract by registered letter with a request for acknowledgement of receipt. This right must however be exercised within sixty (60) days from the delivery date of the initial contract.
5.7 – Upon receipt of the Products Ordered, the customer or the recipient will have to check the good functioning of the delivered goods and will be aware of the conditions of use contained in the instructions manual provided.
5.8 – In the event that one or more of the Products Ordered are missing or damaged, the customer or recipient must file a claim with the carrier at the time of delivery.
5.9 – In case of apparent defects, the customer has the right of under the conditions laid down in the instructions for use of the property.
5.10 -For reasons of availability of the Ordered Products, an Order may be object to several successive deliveries to the customer.
Article 6 – Retraction
6.1 – The customer has a period of 7 days from Product reception to return them to Red Luxury SAS against exchange or refund. In this case, the customer shall return the new Products, intact, with all accessories, instruction manuals and documentation to the following address:

6.2 – In case of exercising the right of withdrawal, Red Luxury SAS will reimburse the sums paid by the customer at no charge except for return postage.
6.3 – Repayment is due within a maximum period of 14 days.
Article 7 – Price
7.1 – The prices displayed on the Site are indicated in euros all French taxes included (French VAT and any applicable taxes), excluding shipping costs.
7.2 – The price indicated in the Order confirmation is the final price including all taxes and VAT. This price includes the Product prices, the costs of handling, packaging and Products storage, transport costs and commissioning.
Article 8 – Payment
8.1 – The price and shipping cost, will be included in the customer’s basket, before final confirmation of the Order.
8.2 – The Product price is payable by means of payment offered on the site the day of the Order.
8.3 – The Order validated by the customer will be considered effective until the secured bank payment center has given its approval on the transaction and, if necessary, after assumption of risk acceptance by the insurer.
Article 9 – Applicable law
9.1 – The present general conditions of sale are subject to French law.
Article 10 – Responsibilities
10.1 – RED Luxury SAS cannot be held responsible for damage of any kind, intangible or tangible caused by the malfunction or misuse of any marketed Product.
10.2 – RED Luxury SAS responsibility will, in any event, be limited to the amount of the Order. In case of difficulties in implementing this contract, the customer and Red Luxury SAS reserve the possibility, before any legal action, to seek an amicable solution.
10.3 – The RED Luxury SAS cannot be held responsible for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or presence of computer viruses, or any other incident qualified as force majeure in accordance with the law and jurisprudence
Article 11 – Warranties
11.1 – In all cases RED Luxury SAS cannot be held responsible for non-compliance with regulations and laws in force in the receiving country. The responsibility of Red Luxury SAS is systematically limited to the value of the Products in question determined at the date of its sale and this without recourse to the brand or the company producing the Product.
11.2 – The watches manufacturer’s warranty usually covers:
– Any defect in materials and workmanship. The watch movement, the hands and dial are the only components covered for this period.
– Any component covered by the warranty will be repaired or the watch will be replaced free of charge provided that the defects in material or workmanship are found in normal use.
11.3 – In case of replacement, the manufacturer cannot guarantee that you will receive a watch of the same model. If your model is not available, a watch of equivalent quality and price according to availability.
11.4 – The warranty does not cover apparent defects. The warranty will not cover Products or Services damaged during transport or misuse. Article L211-4 of the French Code of consumption. If the problem you are having with your watch is not covered by the manufacturer’s warranty or if the warranty has expired, our After-Sales Service (S.A.V) will send you a quote showing the necessary repairs amount estimation by e-mail or by mail. The manufacturer will conduct repairs after acceptance of the quotation from you.
Article 12 – Legal
12.1 – The fill of the personal information collected for the purposes of distance selling is mandatory, this information being essential for processing and delivery of the Orders, the establishment of the invoices and warranty contracts. The Lack of information leads to the non-validation of the Order.
12.2 – In accordance with the French Data Protection and Freedom of Information Law (“Loi Informatique et Liberté”), the processing of personal information about customers has-been declared to the National Commission for Data Protection and Liberties: “Commission Nationale Informatique et Libertés” (CNIL).
12.3 – The customer has (Article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with RED Luxury SAS. In addition, RED Luxury SAS undertakes not to communicate, whether it be free of charge or with a financial compensation, the coordinates of his customers to a third party.
